The District Attorney on my case changed. Why wasn’t I notified?

Cases can be assigned to different District Attorneys for a variety of reasons, including scheduling conflicts. To make sure that you are notified of any changes to your case, you can email your current contact information to MaderaDA@maderacounty.com, or call 559.395.0600.

I am a victim/witness in a case and received a subpoena; do I have to testify?

A subpoena is a court order to appear in court. If you are a victim/witness of a crime, you may have to testify in court. You can email your current contact information to MaderaDA@maderacounty.com, or call 559.395.0600 and you will be contacted by the District Attorney assigned to your case to discuss options. Those options include being placed on call for the day you are to appear in court.

However, many cases resolve without actually going to trial. If this happens, you will not be required to testify, as there will not be a trial.

Is the defendant going to be in the room when I testify?

Yes, but you can have a Victim Advocate or other support person in court with you when you testify. Please notify the District Attorney assigned to your case before the court date that you would like to have someone in court when you testify.

Can I testify via Zoom?

If I do not want the case to go forward, what can I do?

The District Attorney’s Office represents the People of the State of California, not an individual victim. The District Attorney’s Office will make the final decision as to whether or not charges will be dismissed. However, a victim's wishes will always be taken into consideration.

You can come into the District Attorney’s Office with identification and request to talk to a District Attorney Investigator.

Where can I get a copy of the police report?

Please contact the agency to which you reported the crime.

I am a victim of identity theft and am being charged for a crime I did not commit. What can I do?

You can contact the California State Department of Justice (DOJ) to make a report. They will mail an identity theft packet for you to complete. After you return that packet to DOJ, you will then provide this information to our office and we will assist you in completing a criminal record check. If I suffered financial losses due to a crime will your office assist me in receiving compensation?

If a defendant is found guilty, he or she could be ordered to pay restitution to you and/or your insurance company. In order to have restitution ordered, you must provide the office with a summary and receipts for your losses, those can be emailed to MaderaDA@maderacounty.com. Victims of crime can also apply for compensation through CalVCB for medical/dental treatment, counseling, funeral costs and other expenses relating to the crime. CalVCB is the payor of last resort and can only pay for treatment not covered by any other reimbursement sources.
